1. Who is responsible for your information
The controller for the purposes of this policy is Luxury Yacht Charter Monaco, the brand under which labandearenaud.com is operated from Monaco. For anything concerning your personal information, or to exercise the rights described below, you can reach us at [email protected].
2. What we collect and where it comes from
We collect information directly from you and, for visit statistics, automatically as you browse.
- When you fill in our enquiry form: your name, email, phone number if you give it, the yacht you are interested in if chosen, your intended charter dates, the number of guests, and anything you write to us, together with the page you were on and the site that referred you there.
- When you contact us by email or phone: whatever details you choose to share so that we can respond.
- When you tap a WhatsApp button on the site: we log the page you were viewing, the referring site, the site language and the prefilled text, before WhatsApp opens on your device.
- As you browse: our own measurement script, served from our domain, records pages viewed, time spent, the referring site, any campaign parameters in the link, device type, browser, operating system, screen size, browser language, and the country worked out from your IP address. The IP address itself is never stored. If you later send an enquiry or tap a WhatsApp or phone link, that action is linked to the same visit so we understand which channel brought you to us.
- Standard technical logs kept by our hosting provider, such as IP address, time, page requested and browser, for a short period for security purposes.
3. Why we use it and our legal grounds
We use enquiry and contact information to take the pre-contractual steps you ask for, such as checking availability and preparing a quote, and then to perform the charter contract once it is confirmed in writing. Server logs and visit statistics are kept on the basis of our legitimate interest in keeping the site secure and understanding how it is used, without tracking you individually across other sites. Where a booking goes ahead, certain information must be kept to meet our legal obligations in matters of tax, accounting and port formalities. We do not use your information for automated decision-making, we do not sell it, and we send no marketing unless you specifically ask us to.
4. Guest details for crew lists and port authorities
Once a charter is confirmed, the captain or driver assigned to your trip needs the full names of guests on board. This is a standard requirement for the crew list and for checks that may be carried out by port authorities in Monaco and along the itinerary, and it also allows the crew to prepare the boat properly for the right number of people. We ask for these names only at that stage, and only share them with the crew member performing your charter and, where required, the relevant port authority.
5. Who else sees it, including transfers abroad
Access to your information is limited to those who need it to serve you.
- Our own team, who read and reply to enquiries through an internal messaging tool connected to our booking system.
- The captain or driver who will actually run your charter, for the practical details needed to prepare and crew the boat.
- Our hosting provider, which stores the site and the booking system on our behalf.
- Google, which serves the web fonts used on the site and, in doing so, receives your IP address.
- jsDelivr, the content delivery network that supplies the phone-number input library used in our enquiry form.
- WhatsApp, operated by Meta, if you choose to continue a conversation there after tapping a WhatsApp button; that exchange is then governed by WhatsApp's own privacy policy, not this one.
Google Fonts and WhatsApp/Meta may process information outside Monaco and the European Economic Area as part of their own global infrastructure. Where this happens, it results from your own choice to load those site elements or to open a WhatsApp chat, and we do not otherwise transfer your information internationally ourselves.
6. How long we keep it
Enquiries that do not turn into a confirmed charter are deleted after 24 months. Once a charter is booked, the related records are kept for as long as tax and accounting rules require us to retain them. The local-storage entry that remembers you have closed the cookie notice and the one that holds anonymous visit identifiers expire automatically, the latter 30 days after your last visit, and you can clear either from your browser whenever you wish. The session-storage entry that remembers which yacht you clicked on is deleted as soon as you close the tab or send the form.
7. Keeping it secure
Enquiry and booking records are held in our booking system with access limited to our team and, where relevant, the crew member assigned to a confirmed charter. Server logs are kept only briefly and used solely to detect and investigate security issues. The site itself sets no cookies, and the browser storage it uses holds no contact details, only technical markers such as a visitor identifier or your current yacht selection.
8. Your rights, and how to use them
Under Monaco Law No. 1.565 of 3 December 2024 on the protection of personal data, and, for visitors connecting from the European Union, under the GDPR, you may ask us to:
- confirm what information we hold about you and give you a copy;
- correct information that is inaccurate or incomplete;
- delete information we no longer need, or that you no longer wish us to hold;
- restrict or object to certain processing, including processing based on our legitimate interest;
- receive, in a portable format, the information you gave us for an enquiry or booking.
To use any of these rights, write to [email protected]. We aim to respond within one month, and we may ask you to confirm your identity before acting on your request, so that we only act on genuine requests.
9. Complaints, children, and changes to this policy
If you believe we have not handled your information properly, you can contact us directly so that we can put things right, or lodge a complaint with the Autorité de Protection des Données Personnelles (APDP) in Monaco.
Our charters and this site are intended for adults arranging travel; we do not knowingly collect information from children, and our enquiry process is designed for use by the person booking the trip.
We may update this policy as our site or services evolve. The version published on labandearenaud.com is always the current one, and we encourage you to revisit it before sending us an enquiry if some time has passed since your last visit.
